«Luxury Private staff» placement services

The Client shall commission and pay, whereas «LUXURY PRIVATE STAFF» shall undertake the responsibility of providing services for the sourcing and recruitment of candidates for available vacancies in accordance with the requirements specified by the Client in the Request(s).

«LUXURY PRIVATE STAFF» shall:

1. Source and select Specialists according to the Request of the Client.

2. Prepare and provide the Client with information (CVs, references, etc.) on the selected Specialists.

3. Arrange for a personal interview between the Client and their selected Specialists.

4. At its own expense and means, replace the Specialist in the event of their dismissal during the warranty period (3 months), except where such dismissal is the result of actual changes on the part of the Client in the conditions of work previously specified in the Request.

The Client shall:

1. Submit a Request(s) to «LUXURY PRIVATE STAFF» indicating the Specialists required for the vacancies and the list of requirements for such Specialists.

2. If necessary, arrange for «LUXURY PRIVATE STAFF» to familiarise themselves with the activities of the Client as reasonably required for the recruitment of Specialists.

3. Review and inform «LUXURY PRIVATE STAFF» of their opinion on the information provided for the Specialist and make an appointment for an interview with the Specialist.

4. Make a final selection of the candidate and, having decided on the employment or rejection of each of the proposed candidates, inform «LUXURY PRIVATE STAFF» within 3 (three) working days from the date of the candidate interview.

5. Make a decision on the employment or rejection of the Candidate following a 3-day trial period.

6. Prior to the Specialist starting work, with or without the signing of a contract, the Client shall undertake to pay for the services of «LUXURY PRIVATE STAFF» for sourcing the Specialist for the vacancy specified in the Request, or for a different vacancy, or for a different format organised in conjunction with the Client. Evidence of the commencement of work by the Specialist recruited by «LUXURY PRIVATE STAFF» is considered to be the actual start date of any work by the Specialist, or the provision of any services in the interests of the Client.

7. Our fees:

7.1 Permanent domestic staff placements are charged at 100% of the month’s salary, any domestic staff engaged in a role for 3 months or more is considered permanent.

7.2 Temporary private staff placement is charged at 20% of the total salary earnings for the period of employment or a minimum charge of €350 EUR. This fee applies to domestic staff hired hourly, daily or monthly for less than 90 days.

8. In the event a temporary private staff placement results in permanent employment, then such fees shall become applicable and any shortfall invoiced accordingly.

 

The Parties undertake that if a Client makes a negative decision with regard to one or any candidates recommended by «LUXURY PRIVATE STAFF», the Client may not, for a period of one year from the date of that decision, offer any work to these candidates within their organisation without the written agreement of «LUXURY PRIVATE STAFF». In the case of employment of the above-named candidates, payment by the Client for the services of «LUXURY PRIVATE STAFF» shall be made according to the paragraph of the vacancy Request that most closely resembles the requirements for the employed Specialist.

If the Client employs the candidate recommended by «LUXURY PRIVATE STAFF» for a position not specified in the Request, or recommends the candidate to other persons or entities for employment that results in the employment of the candidate, payment by the Client for the services of «LUXURY PRIVATE STAFF» shall be made according to the paragraph of the vacancy Request that most closely resembles the requirements for the employed Specialist.

All disputes and differences that arise in the collaborative process should, where possible, be resolved through negotiations between the Client and «LUXURY PRIVATE STAFF». If the Parties are unable to agree, the matter shall be subject to legal proceedings in accordance with French Law in the Nice Court of Arbitration.
